Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Betterfound ("Service"), operated by Betterfound ("we", "us", "our"). By creating an account, installing our tracking snippet, or paying for a plan, you agree to these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

Betterfound provides privacy-friendly website analytics, including dashboards, goals, reports, API access, and MCP integrations for AI agents. Features and limits depend on your plan. We may improve, add, or remove features with reasonable notice when a change materially reduces paid functionality.

3. Accounts

You must provide accurate account information and keep credentials secure. You are responsible for activity under your account. Sign-in is provided via Google OAuth. Notify us promptly of unauthorized use at hello@betterfound.com. We may suspend accounts that violate these Terms or pose security or abuse risk.

4. Acceptable use

You agree not to:

• Use the Service unlawfully or to infringe others' rights
• Attempt to reverse engineer, overload, or disrupt the Service
• Resell raw access or scrape competitor sites at abusive volumes
• Transmit malware or attempt unauthorized access to our systems or other customers' data
• Misrepresent website ownership when installing tracking or claiming sites

5. Website owners & compliance

You are responsible for how you use analytics on your websites, including disclosing analytics where required by law and obtaining any consents that apply to your jurisdictions. Our script is designed to avoid cookies and personal identifiers, but you remain the controller of your site's visitor relationship. See our Privacy Policy for how we process Service data.

6. Plans, billing & Founding offers

Paid plans bill via Stripe on a monthly or annual subscription unless otherwise stated. Fees are prepaid and non-refundable except where required by law or expressly stated (including sold-out Founding refunds). You can cancel subscriptions in billing settings; access continues through the paid period. Overage fees may apply when you exceed plan pageview limits, as described on our pricing page.

Limited Founding offers (e.g. Founding 20) may provide prepaid Growth access for a fixed term via one-time payment. Founding seats are limited, non-transferable, one per account, and cannot be combined with coupons. When a founding term ends, renewals are offered at then-current list pricing; without renewal, access may pause or move to a free/limited state.

7. API keys & MCP

API keys and MCP access are confidential credentials. You must store them securely, revoke compromised keys, and not embed them in public client-side code or allow models to print them. Abuse or credential leaks may result in suspension.

8. Intellectual property

We own the Service, branding, and software. You retain ownership of your websites and the analytics data we process for your sites. You grant us a limited license to host and process that data solely to provide the Service.

9. Availability & data retention

We strive for high availability but do not guarantee uninterrupted Service. Data retention follows your plan. After cancellation or expiry we may delete account data after a reasonable grace period, except where law requires longer retention.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that analytics metrics will be error-free or that the Service will meet every business requirement.

11. Limitation of liability

To the fullest extent permitted by law, Betterfound and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our aggregate liability for claims relating to the Service will not exceed the amounts you paid us in the twelve (12) months before the claim.

12. Indemnity

You will defend and indemnify Betterfound against claims arising from your websites, your content, your misuse of the Service, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access for Terms violations, non-payment, or risk to the platform. Provisions that by nature should survive (including IP, disclaimers, liability limits) survive termination.

14. Changes

We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after the effective date constitutes acceptance. If you disagree, stop using the Service and cancel your plan.
